My sister and her husband have a legal separation. He resides in CA (military) and she resides here. In their separation agreement it states that they have joint custoday, that he can have Aiden (their son) for a min. of 2 months, at my sister's agreement.
Beginning of May she allowed him to take Aiden, verbally agreeing it would be about a month, but Aiden would come home sooner if he wanted to. Well, her husband is now stating that he is not letting him come home until August and he is taking him to TX to get baptised in his girlfriends church. My sister wants Aiden to come home and Aiden too wants to come home. He is not discussing this with my sister, just telling her that is how it is going ot be and that is that.
She has an attorney and it is free since this is a domestic violence case, however her attorney is not advising her and is always too busy to even discuss anything with her.
What rights does my sister have on getting her son back? Is there anything that she can do? She's scared to try to argue with him too because he keeps threatening a big custody battle.
