kids

The kids and I have recently moved to the US with my new husband. We are British citizen and US residents. The kids biological father resides in the UK. Things are obviously not in good term with my ex-husband and I, but I do want the kids to go back to the UK so that they could visit him. Non of has hold full custody of the kids as we didnt bother going through this process during the divorce. How can I send the kids to the UK without him keeping them there?

Are there ANY custody orders? If not, then there isn't anything to enforce.

You should establish custody and visitation orders, and you may have to do that in the UK. If you moved here recently, then you probably don't meet the residency requirements for filing. However, even if you meet the requirements, the UK most likely will retain jurisdiction.

You need to consult an attorney.

Your ex could file for custody in the UK. You should not have moved to the US without permission from the UK courts. Britian likely has jurisdiction anyways. There really is no way to prevent dad from trying to keep the kids. You basically are doing the same thing by moving that far away
