Custody question

Hello,

I just had a baby six weeks ago. The father was relocated to Oklahoma when I was seven months pregnant. We were never married but I planned to join him there after I gave birth. A week after I had my baby I found out he was cheating on me. So we are no longer together.

My questions are these: First, he wants joint custody but I am concerned because he is an ex drug addict that I suspect is using again and he is also a heavy daily drinker. He lives with his father and is on call 24 hours a day. I got the paperwork from the court house to file for sole custody but how do I introduce these concerns? Secondly, can anyone tell me what the law is for a child going out of state for visitations? Is there an age min.?

Unmarried fathers typically do not get unsupervised visits with newborns, especially over state lines. You can certainly request supervised visits either in your home or at the home of a 3rd party in your state. Eventually Dad will probably get unsupervised visits but that is probably sometime in the future.

You can request a drug test, it may or may not be granted. You need sufficient proof Dad is doing drugs to request this. Him living with his father probably isnt a big deal.

You might want to call legal aid or an attorney for some advice.
