Please help! My son is 16 years old and his father has decided, after being the occasional father, that he wants him to live with him now. He has told him that he would buy him a new car, cell phone, etc. if he moves in with him. He told my son that it will only take a week for him to go to court and say he wants to live with him and that will be that. He has told my 16 year old that he can do what ever he wants with no rules at his house. Can that happen? Can I lose my son because my ex can buy him more gifts and has all the freedom he wants at his house? I have devoted my life to this child, Can this happen? I live in Florida, Does anyone know? Please help me..........

If your ex has not used his regular visitation to maintain a relationship with your son, then I think it's unlikely that he can obtain primary physical custody. At 16, your son's wishes can be considered, but the court will probably look at the history of visitation. Also, if there are no substantial changes in circumstance, it will also be difficult for him to establish a good reason for a change in custody.

Florida's statutes on custody can be found here, if you wish to research on your own:
