Courts generally prefer to keep children with their parents if possible; however, your grandson has lived with you for so long that you may have a decent chance. You should consult an attorney as he/she is familiar with the family courts in your area, as well as your state laws.

I think it might be a good idea to document your son's lack of involvement in his child's life up to this point. That could include attendance at parent-teacher conferences, medical visits, registration/participation in extra-curricular activities (sports, music lessons, whatever). You probably have receipts or forms that you had to sign for almost everything.

Good Luck :)

Maybe u can answer my question or know someone who can. my x told the courts she filed her response to our child visation case and served me via us mail on the 21st of july. what she really did was turn in her response to the court and a proof of service on the 21st but did not serve me until the 30th of july which was 2 days after her response was due can i prove some sort of falseafication to the court an maybe get a defult judgment and how do i go about it thanks

I'll be happy to help if I can, as will others, but you'll have to start your own thread. You can copy and paste your original post into your new thread. Please also include how your ex served you.

Thanks!
