My son & his girlfriend have lived with us for 6 years (downstairs apt/rent free), during that time (12/2004) they had a baby boy. (They were married in 2001 & divorced in 2002, got back together in 2002). She moved out a couple of times for 4-6 weeks then would move back. We allowed this only because we wanted to insure the baby was taken care of. During the time they have lived with us my husband & I have supported them. My son worked most of the time(construction) & when he was working would provide necessities for the baby as he could. When his girlfriend worked she didn't use her pay for even her own necessities much less the baby. My husband, myself & my son have taken care of the baby most of the time because she felt he was a burden & didn't act motherly toward him even being mean to him until we would intervene. We didn't do anything at that time because one of us was always on hand to look after the baby & see that he was taken care of & treated right. The girlfriend has moved out again (end of September) & has made false accusations against my son of abuse to her & the baby and received a no contact order with no evidence of abuse. She refuses to let any of us see the baby. She has lived with 2 different men since leaving that we know of (we have heard there were 3). The night she left she went directly to her new boyfriend & began living with him, within 30 minutes of leaving. We are concerned because of the way she treats the baby (he's now almost 4) when she is not neglecting him. She leaves him with different people when she can so that she can "party" & takes him with her when she can't find a babysitter. We have been hearing (through mutual friends of hers & my sons) that she gets drunk & stoned regularly. She is now living with the third boyfriend & he claims to be a "juggalo" & now she is claiming she is also. I didn't know what this was so researched on the internet. After researching this I am certain this is no place for a child to live. My son has since been to court on the "no contact order" and the Judge rescheduled for 30 days & told my son to file for visitation. He seemed to believe my son that there was no "abuse". My son tried to file a petition for visitation & was told since they were married (even though they had been divorced for over 2 yrs before the child was born) that he would have to get an attorney & file through circuit court. He was unable to use Legal aide because they are not accepting any visitation or custody cases at this time. Went back to court on the "no contact", the Judge hardly even addressed her alleged abuse, but now understood they weren't married when the child was born & said she will have to file for DNA test to be done even though my son signed at the hospital agreeing he is the father & he is listed on the birth certificate. My son doesn't have money to hire an attorney (most we have contacted require $1500-$2000 retainers). We can help some, but don't have that kind of money either & don't have any way to get it. We are all very concerned over the baby's welfare. What can we do? She is still not allowing us to see him, we don't even know the address she is living at now? Sorry so long, but wanted to give some background!

1500-2000.00 is not alot for a retainer. See what you guys can do to all chip in for one. He can call around to attorneys and google fathers rights groups to see if anyone can help. I am really surprised the judge is ordering a DNA test since paternity has already been established. There must be a loophole in your states law that allows that.

So start calling around and see about getting an attorney for him asap.

Can you rent out your basement for extra money? If your son is there move him up with you.
 
No, this is not alot for a retainer but it is alot of money to us. Unable to rent the basement out at this time. But, thank you so much for your advice. He will check out the other options you gave & we are all pitching in & still trying to get the retainer $$ together. Thanks again.

go to your local juvinial court officer and tell them you need emergency tempory custody and thet you have wittnessed this abuse and you are concerned for the childs safety. Call Childrens services and ask for a wellfare check to be done. Call the local police and ask for them to do welfare checks in the middle of the night(espically on friday and sat. nights). Ask around and find where she is residing. I know there is a law in the state of Tenn. if a parent moves and does not give the other parent an address for the child it is considered kidnapping. I am not a lawyer but I have been through this with family. you may want to ask around to attnys. if they will take payments (some will) or ask if any of them will do probono(free) work for your case. If you are in the west Tn area our state representive Vance Dennis is very good and will on occasion take payments. :angel Good Luck and God Bless.:angel

This thread is almost a year old...It is doubtful that s/he is still having the posted issue. Please don't post to old dead threads. If you click on "new posts" those are the current active threads under discussion.
