court order ?????

I was wondering if anyone could help me. My boyfriend has 3 sons, 2 live with us full time and the other lives with their mom. Every weekend we get the other son and all summer long we have all 3 kids, there is no custody agreement in writting no court order and no child support paid my either party. The one son that live with us cannot get a long with the one comes on the weekends and all summer, we want him to spend the summer with his mom but have been told by the local police who have been to home for him
several time that we cannot make him live with his mom with out a court order he is 16 years old. Do we really need a court order and how would be get on ????

Even with a court order, you cannot force the mother to take the 16 year old. Visitation is a right, not an obligation.

I'm a little shocked that there is no custody order in place. If the father wants to establish custody through the courts, he can probably find the forms online through the local or state court's website. Otherwise, they can be obtained at the courthouse.

If both parents have similar incomes, then the fact that 2 of the children live with father would probably result in a child support obligation for the mother. If all 3 children live with the father during the summer, then that may also increase the mother's obligation. Of course, this is all state- and circumstance-dependent.
 
The mother wants to take the child for the summer but we have been told that because he is 16 and there is no court order we cannot force him to go. The father is on ss and food stamps for him self and the 2 kids he has full time. Their mom is a district manager of friendlys.

The father can file a petition for custody and visitation in the court. Were the parents married? Are they still married? How long have they been apart? I'm confused about the child support. Generally, when a custodial parent receives state benefits on behalf of a child, the state expects, and pursues, repayment in the form of child support from the non-custodial parent.

As far as forcing the child to visit his mother, the police do not enforce custody and visitation orders, even if they had one. However, the parents can set the rules and expect him to follow them.

the child in question is 16 years old and bipolar he thinks the world is wrong and he is right and no one can tell him what to do he has been hospitalized several times the police have been called to our home several time when we have been unable to control him and he has hit his father and brothers
this is why we want him to go live with his mom over the summer, he will not go and the last time the police were there they stated they cannot make him go as there is no court for him to live there, but there is also none for him to live with is dad either

The police cannot 'make' him go, even with a court order. That's the parents' responsibility. I don't know what to suggest, but it sounds like he's out of control. If you haven't already done so, you might want to see if there are any services through the DHS. Try this site for more information:
