What are possible defences of conversion?

Let's first offer the common law definition of conversion for the uninformed.

Under common law and tort law, conversion is the intentional deprivation of another of the benefit and use of his property, without his authorization or lawful justification, by possessing or disposing of the property as if it were your own or by an act (such as damaging or destroying it) that interferes with or is inconsistent with the lawful owner's right to use and/or possess the property.

So, you're inquiring about some sort of theft.

The major defense involves the actor's INTENT to PERMANENTLY deprive the legal owner access or use of the alleged converted (stolen) property.

Note: The property in question is personal property, as opposed to real property.

I suggest that anyone who finds himself or herself charged with any crime to remain silent, stay calm, be civil, plead not guilty, and ask for a lawyer (or hire your own). Then be patient and wait. Time and silence are your two best friends, as well as a good lawyer.
