While on vacation from 3/30/09 to 4/10/09, I started working for a staffing agency on 3/30/09. I resigned from a job I had for 3 years on 4/17/09. I bought a new car on 4/18/09, paid $1000 down. I showed the car salesman the 2 most recent paystubs from the job I had for 3 years. The car was delivered to me on Tuesday 4/21/09. On 4/28/09, the dealership tells me to return the car because the finance company wont honor the contract due to my new employment.

Can I get my $1000 down payment back? Can the contract be nullified? Is there a breach?

Thank you,

Nufella

Without knowing the terms of your contract, it is impossible to say whether it was breached or what the consequences might be. You might have breached the contract, you might have made a negligent or fraudulent misstatement that entitles the dealer to rescind. There is know way of knowing on the facts set out whether you are entitled to your down payment back.
