Question...I have a situation where a friend's daughter is 2 years old. She visits her dad at Christmas for one week alternating one week before or one week after every other year. She dropped her daughter off to the child's father at 4 p.m. on Christmas Day and had agreed to pick her up on January 31st. He sent a letter to his lawyer saying that he was keeping her until January 6th. He is not supposed to have her for that length of time until she is 5 years old. What should she do? Her lawyer said they could file for contempt or do a clarification or something like that. She is going crazy right now. What would you recommend. The order stated that in odd years he has her one week after Christmas and even years one week before Christmas until she is five then it changes to go from a school schedule. It seems he is trying to jump on the age five time period instead of the under five time period.

First off.......Does it really matter.......Shouldn't she have some time with her Dad. You need to understand that the courts look at this.....They will see this as petty. If she is in good hands, and being taken care of then I would just leave it alone and let her have some visitation time with her Father. If he is dangerous, or not taking care of her then that is a diffrent story and you should act swiftly.
Remember.......ITS NOT ABOUT YOU, OR THE CHILDS FATHER........ITS ABOUT THE CHILD, AND WHAT IS IN THE CHILDS BEST INTEREST!!!
Good luck
