It'll be long but you'll understand if you hear the whole story.....The court orders states: Parents shall split Christmas vacation with father having the half including Christmas in the even years with exchange on the 9th day of the vacation 8 AM at the Police Department and Mother with half including Christmas in the odd years with the exchange on the 9th day of the first have of the vacation 8 AM at the Police Department..... Okay so the 9th day which is switch day would have been the 27th of Dec. I recieved an email from my ex stating that I wasn't going to get our son until the 29th. I replied with....I have the current court orders which states that I get him on the 9th day which is the 27th. He replied with oh my bad I counted wrong, but you still don't get him until the 28th. I proceeded to go to the police dept on the 27th and he wasn't there. The police officers read the orders determined that the 9th day was in fact the 27th, the officers called my ex, but ended up getting the new wife which said that of course my ex was out of town for the day..... The officers told her that he was in violation of the orders and she proceeded to agrue that fact with them. The police officers my boyfriend and myself went to my ex's house after the phone call was made to see if he really was gone. Of course he was. Later that afternoon we meet the police at his home once again because my ex's truck was there. We had seen him before the police officers came come and going from the garage. When the police finally got there, of course my ex just disapeared once again and wasn't there. From this point the police said that since he keeps hiding out and not giving up your child its turned into a civil matter.....I did end up getting my son the following day since it was okay by my ex of course, (his idea)!! Anyways he ended up filing contempt charges on me for having the cops harrass him by calling and "trying to get our son a day early". They also are charging me for being at there house, etc. I know I did nothing wrong....I am wondering if I should turn around and charge him with contempt for not going with the court orders or if I should wait and bring it up to the judge when we go to court for my contempt? I cannot afford an attorney and I really can't afford to file contempt charges on him....should I just wait until my court date and pray that the judge make the decision and files charges on him???
