I have a construction company that is bonded and my wife and I signed the surety's indemnity agreement which included language such as a confession of judgment. Basically signing every right I have away in advance of anything happening.
Things happened and now the surety has a judgment in a Pennsylvania court with no formal notice to me (because I waived it in the indemnity agreement). Said agreement was signed by my wife in Florida, I signed in South Carolina and we both reside in Florida.
Is there any legal defenses to this stuff? How can I protect myself against the surety such as assetts, bank accounts, future work, etc???
