My mother is committed to a behavioral ward of a hospital. Her condition is really not that bad, but the Dr and the Head Social worker claim her to be incompetant. I dfind her to be very competent and one of the social workers and a nurse agree with me. This is very imprortant as I would like her to execute a DPOA for me, but the Social worker is forbidding it - Is there any action I may take to prove my mother's competence?




On the flip side, the Social worker is telling me I'd better obtain a guardianship or else the State of NY will become my mother's guardian and they will seize her assets and put her in a group home. Only problem is I do not have the money and would need to borrow funds in order to pay for a Guardianship proceeding - Will I definately be reimbursed for all attorney fees I incur?

It doesn't sound (from your facts) that ma can execute a POA.

Why don't you tell the bureaucrats that THEY need to file for guardianship?

Does your state have a public guardian?

Do some research.
