Hello, My current employer has just released our new commission structure for the month of March. Each month they change our commission structure, and it is usually out by the first or second of the month. This month they released it on the 14th. Originally they said it would be similar to last months, but since then, everything is completely different. I feel like i've been cheated since I worked half of a month and found out I currently do not qualify for commission. Is there any legal action I can take?, or do I need to wait till I don't get paid? I feel like they are waiting to see where all the sales reps are at so they don't have to pay out so much. I'm pretty sure that is unethical. PLEASE HELP. I am currently looking for another job. Also this is a huge corporation that is worldwide.

It might be unethical but probably not illegal. I am also in sales and work off commission. Although my company does not change it monthly, it gets tweaked about once or twice a year. Are you paid a base? Maybe if enough employees talk to mgmt about the unfair last minute changes, they will make it more fair?

Missouri has some odd laws but I don't think they will look kindly on a retroactive change of commission schedule. Going forward, yes; retroactive, no.

I could be wrong but it wouldn't hurt to contact the MO DOL for guidance.
