Coming back to New York

Just a general inquiry about the ban the box. It looks like New York is a part of it. it says, No criminal inquiries prior to conditional job offer. Does this mean during an interview they CAN ask? I'm trying to answer as accurate as I can for my son looking for work. He does have a felony and just finished probation, F.I.T., and Community resource court program in N.C. He will be coming back to New York, Any help/knowledge is appreciated.
