Claiming son on taxes

I was divorced in 2000. The judge gave my ex our youngest son to claim on his taxes . I got the 2 older children. My ex has not worked in 2 years , and is in 17,000.00 arrears in Child Support. My youngest son who he gets to claim, has never lived with him , and has no contact with him . I have been remarried now for 5 years , and my husband now is the one who has supported my son all this time. My ex cannot claim him on his taxes since he has not worked in 2 years , and I was wondering can my now husband claim my youngest son on our taxes ?
 
You shouldn't get in trouble with the IRS. You are actually entitled to claim your son per IRS regulations. That's why you have to sign the 8332 form for your ex to claim your son.

Your troubles will arise if and when your ex tries to claim your son again. You will be in contempt if your husband is unable to claim him.

Until your ex gets a job and requests the 8332, I don't think you have anything to worry about if you claim your son on your taxes.

If you want to make it official, you can probably take it back to court.
