Civil Summons for Debt Collection

I owe a bank credit card company $ 5,000. They added on penalty fees of
over $ 2,500. They filed a civil summons in the district court. I immediately
responded to the summons. In addition, I am unemployed and had sent
numerous letters prior to the summons trying to resolve the matter. I even
offered a settlement of $ 3,000 that family members offered to me. They
refused it all.

Now that it has reached this point and I have responded to the summons.
Can I still request a debt validation from the bank? Should it be in a
Motion format or just a letter? Does the court need a copy as well?
Also, I was advised that filing bankruptcy was better than a judgement.
Would I file bankruptcy prior to the court hearing or after the hearing?
Last question, I can't afford an attorney. Will I definately get a judgement
if I do this hearing on my own? Please advise on these three questions.

This is more than likely being done by a debt collector/scavenger bunch of thugs.

A bankruptcy would stop the court battle.
They would never get a judgment.
The federal bankruptcy court would keep them from EVER bothering you.

No matter what you do, your credit has already been hurt.
It won't be fixed anytime soon.
You shouldn't have to deal with these creeps.
In this economy finding a job is hard enough without these sharks tearing into your flesh!
The best thing you can do is minimize things.
Bankruptcy isn't easy anymore, but its made for people having a tough time.
You would qualify.
Why spend 43,000 when you don't have it?
File a bankruptcy and make this nightmare end.
Get some peace back in your life.
Then you can get a fresh start.

DON'T TAKE THAT $3,000 UNTIL AFTER YOU'VE FILED THE BANKRUPTCY.

Civil summons for debt

I owe a loan company and didn't make three months of payments. I called loan company as soon as I was able to pay the loan. They took $2500 from me before they told me that I was being sued. I was told to call their lawyer. When I did I was told that if I wanted to settle that I should send in a proposed settlement letter. I did. (Mind you I never recied the paper until two weeks after I spoke to the loan company.) Never heard from them since. I finally got incontact with the lawyer's office a week before the court date and was told that the loan companyy would not settle for the principle and interest that they also wanted court cost and attorney fees. They said that if I signed their settlement letter I wouldn't have to go to court and would not have a judgement against me. I don't know if it is in my best interest to sign or got to court. This ordeal already reduced my credit score severly. Please advise....
