I was just wondering how long a summons for visitation lasts for? I think my ex is trying to summons me I seen the guy leave as I was coming home. Also Im not home during the day so what happens if they cant summons you? He does have an order of protection to stay away from me and my son for 2 years. So I would imagine that something horrible like him being able to take him from me because I never got a summons couldn't happen right? Thanks

You cannot dodge a summons, and they can even probably leave it for you. It is not necessary for you to sign for it. If he files a motion in court you must respond to it.

If he is so horrible, all the more reason for you to address the legal issue.

I'm not trying to dodge the summons. I'm cleary stating that I seen the guy leave my house as I was coming home and wondering how long they try to summons you. Okay if he files a motion in court how in the heck am I suppose to know he did that if I never recieved a summons?!?

You should look online to your court to see if they have any outstanding cases for you. Many courts have all this stuff online. It is a real headache if this does happen to go through and you do not know about it, you then have to appeal that you were not served.

Generally they will make several attempts before anything is scheduled. Plus it is possible this man you saw was not even a process server, he could have been anyone.
