my 2 stepsons live w/ me, my husband and my 2 children.Going on 3 years now. The boys mother had custody of the boys for yrs and there were some issues and we told her they either come and live with us , or we were going to take her to court and it would all come out there. So any ways she typed up her own ammendement to the court order saying There shall be no further child support owed by either party to the other after this agreement is made.Even if the boys went back to their mothers for some strange reason ,it was saying that my husband would not have to pay child support to her. Which everyone knows that would not stick. She'd have us back in court so fast to get the money.So what i want to know is how legal binding is this agreement? They both signed it.But it hard raising these 4 children on our income. and she pays NOTHING!!!!!! she will even call the father when they are with her visiting wanting to know if she can have money to pay for things while she has them. She and her husband both work. I just don't know what our options are. and also does my husband have to be the one to persue child support through the courts or child support services or can i do it myself.

Was the "agreement" ever entered in court? It may or may not hold up, no way to know for sure until a judge makes a decision.

no it has not been in court just an agreement she typed up and they both signed.
There is a court before they agreed to this that they both have joint custody and he is to pay child support of 275. and provide medical insurance. I have been told by friends that, that order in still in affect and the courts would look at that as if HE should still pay her CS even though they have been w/ us going on 3 yrs.
