I am seven months pregnant and the father of my child and I are trying to figure out child support without having to go to court. I live in MN and he lives in FL. Once the baby is born he want to fly to MN one weekend a month until he can move there permanently, which won't be for another two years due to his current job and contracts. He is currently making $60,000 a year and states that he is going to pay $500 a month and will also be taking the cost of his monthly plane ticket out of this amount. Obviously, it looks like I am going to need to get an attorny based on this amount. Does anyone have any idea what someone making $60,000 a year should have to pay in child support and should his plane ticket be taken out of the monthly child support payment? Thank you for your help!

What do you make per month? In my state it's a percentage of the difference between the two salaries. Also figured into the calculation is the amount of time spent with each parent. Since you have the child 100% of the time, living another state, the percentage of the difference would be higher.

As far as the traveling...I would think it's his decision to make the trip and shoud not factor into the child support equation.

I am currently making $25,000 a year, and living with my parents. I am much younger then him and still finishing college. So once the baby is born I will be going to school full-time and will only be able to work part-time in order to finish my degree sooner.

A full time income will likely be inputed for you. You are expected to work full time so if you work part time that is fine but a full time income counts for you.

Your CS amount sounds a little low. You really need to google what the MN child support guidelines are. Generally both parents incomes are looked at. You do not need an attorney to file for CS. So after the birth of the child you can file for CS at your states child support website. There are lots of things you need to keep in mind. First of all who is going to carry insurance on the child? I would ask Dad cover that. In turn he might get a small CS credit but it depends how good his insurance is. Also are you going to have any day care expenses? That can be split as well.

Also I do not see why he should receive any travel credit. If you have always lived in seperate states, you did not necessarily create the distance. So travel credit may not apply here.

You should always set up a CS amount through the bureau otherwise technically he doesw not have to pay.

You really should consult with an attorney just to make sure all your bases get covered.

We where both living in MN, but I moved while I was still pregnant. He is also from MN and can move back if he wanted to but choses to stay in FL due to his job. Will this matter in the plane ticket costs? I am also wondering in which state do I file CS in. Is it the state that the father lives in or the state the baby is born in?

If you moved then you created the distance. It is possible the courts may give him some travel credit. You really need to go through the courts now since you have several issues. Jurisdiction should go where the child lives as long as you meet the residency requirements. He won't be required to move back if he does not want too. If you meet the residency requirements for MN once the baby is born you file there.
