This is a long story so I will try and make it short as to not bore you. My daughter was 6 months old and her father hit her by accident. A case was brought up and he was given a case plan to complete before he gained full rights back. He was only allowed supervised visitation 1 time a month for 1 hour through DCF. He completed half the plan and stopped visiting. After 1 year they closed the case. Part of what I was ordered to do was keep her away from him and cooperate with the DOR because I was placed on assistance for awhile. Here it is 2 years later and I FINALLY got a hearing. I informed him of the hearing because he never said anything to me (I know he'd be pissed, he refuses to pay because he is not allowed to see her). He purposely did not show and they went on without him because they had proof enough he was served. He is now livid and is planning to appeal the hearing. Can he do that? I do not mind as they based his income on minimum wage and I know he makes much more so if he appeals and it goes back then he will be paying more for back child support and for future. Also, he said he will take me to court for custody/visitation. I know he much petition the case to be reopened in order to see her at all...his visitation at this point must be done through a service. I have full custody. My husband is the only father she knows and we have been trying for a year to get my ex to sign his parental rights over in order for my husband to adopt my daughter...he won't I mean he says he wants to but hasn't done so. #1 If he petitions the case to be reopened will I be notified and will I have a say? Can I have his rights terminated at that hearing? He has not seen her in a year and a half and has had no contact what so ever...no cards or calls. I do not have the money for an attorney but will get some if he tries to come back into my little girls life. Can you help me as to what he is actually capable of getting given his felonies, abussive history, non-interest in her in the past year and a half.....thank you!
