Hello.

My 5 year old step daughter was molested by a 12 year old boy in North Carolina. My husband [biological father] and I live in California, so the biological mother was the primary care for the daughter.

Social services was obviously involved and did an investigation of this incident.

My husband is active duty military and has requested to be sent back to North Carolina for the welfare of his child, but we need proof of this incident to show the military that the kids are going through tough times.

We called Social Services office of that county, and state office only to be told they will not provide nor release anything to do with the case; they would not even confirm that there was a case with the child's name.

How do we go about getting some sort of paperwork showing this child's case???

Please don't refer to the parents as biological mom and dad. That implies that their rights have been terminated as in an adoption. It's just Mom and Dad. :)


Who call SS to request this information? I ask because you said "we". If YOU were the one to actually request this information then that could be the problem as you are not LEGALLY a party to this. It is unlikely that a SW will release information on the phone anyway. Your hubby should hire an attorney in N.C. to handle this for him. Also it is important to know if Dad has been LEGALLY adjudicated Father of this child? Is there a custody order?

Is the 12 year old boy a member of the child's household? A relative? Is Mom being investigated for Neglect or Endangerment in regards to this case?
 
My husband has joint custody over the child, and the 12 year old boy was a neighbor's son when they were babysitting the child.

Yes I was the one to call SS to request the information, I asked if he should call to request it and they said, no matter who called that ''according to the NC HIPPA LAW they could and would not release any of the information''.

We don't want the information released over the phone, we don't even NEED to see the paperwork. We need copies of it sent to the military to show proof of it that the mother was being neglegent by choice of babysitter while she ''went out'', that way my husband and I can go back to N.C. via military orders.

And we have no idea who is being investigated, that is one of the main reasons SS would not comply with my request to receive copies?
