Child/Alimony Support

My jurisdiction is: Virginia

Have been married since 2000 and currently separated (4 years). I left the family home out of fear of a dangerous environment (shady characters hanging around) for me and my son. I was given physical custody of my child but we have dual custody. I am heading to see an attorney as soon as my finances improve shortly.

Husband has been incarcerated the past 3 years on dealing narcotics charges and will be released this summer. I have a feeling he will have his family support him and never hold down a real job. They live in the state of New York. Most likely claim no one will give him a job because of being an ex-con. Can I expect any support from him for my child and myself? Would I also be able to receive any back-support? His parents have been sending me a $200 check to assist, but that's not nearly what I need. My earning are very low and I really need the assistance. What is the most likely outcome and can the state make him find a job? I am getting desperate.

You probably cannot receive back support if he is incarcerated sincehe has no means to pay. you can file for support when he gets out but I would not count on getting much from him. I doubt he will be able to secure great employment just getting out of prison. Dad can also file for visitation rights.
