I wanted to know if I can file a petition of abandonment against my daughters father. I have full custody. I left him when my daughter was 5 months old he didnt see her again until she was 2 years old. Then it was on and off till she was 3. He then stoped seeing her for 6 months. Then off and on again. He has been in and out of jail. 2 years ago he had neglect charges filed against him, tried to kill himself. She than got a order of protection against him. He got a DWI this summer, then last month he got another DWI and know he is in inpatient rehab. He hasen't seen her in 2 years. Is that cause for abandonment? I live in New York.
