Changing custody without going to court?

My husband and I want to have custody of his son. The son currently lives with his legal guardian (she is not his mother). If all parties agree (incl the mother) and there are no disputes would we be able to change custody without going to court?
If so, where would we find the correct forms to fill out? Does it have to be notarized by a lawyer? Does it have to filed at a court to make it official?
My stepson and his guardian resides in Indiana. Would it have to be filed there?

It is NEVER a good idea to do this without going to court, because unless its signed by a judge, mom or the legal guardian can always come get the child.

Is there a child support order for your husband? He'll want to get custody changed to that his CS stops.

What state has jurisdiction over this? You can try going down to the family court and seeing if there is a law library/family court fascilitator that can perhaps point you in the right direction.
 
i am no lawyer but u should be able to get a agreed modifacation. have a lawyer or legal aide draw up papers saying who gets custody, who gets to visit and all the nessasary aranments nameing ur husband as managing conservator. once papers are draw take them to the courthouse where the last papers were filed. file your papers geta cause # then take them to the county judge and ask his office to direct you on what to do next. i live in texas and went to www.divorcehelp.net and got lots of amswers and help
