Changing A Childs Last Name

I would like to know if any one knows what i need to do to try to get my childs last name changed to mine she is 5 years old .... my ex never sees her i have an order for child support but i rarely get it if at all ..... it is at the point where he is going to go to jail because he owes so much money ..... he refuses to get a job he refuses to come see her ....... she uses my last name every where but at the doctor and i would like to legally change it i dont know what to do though........

You will most likely need the father's permission to change the child's name. If he will agree, then visit your local courthouse to get the necessary forms and procedures.
