I have a bit pf a problem. My girlfriend and me want to move around 82 miles away from our current location in Fargo ND to a house we found by a lake in Berret MN. She and me have a child otgetehr but she has sole physical custody of her three kids from a previous marriage and her and her ex both have joint legal custoday. He has visitation rights to a degree of every other weekend and 2 weeks in the summer. He has quite a bad background including simple assault against her and is also on file at the rape and abuse center. he has also cause numerous problems recently in our lives. What are the legal steps we can take to be able to move the children to our new house in a few months and also what are our chances of winning the chance to move? I seriously need help with this. Thanks.

since you 2 are not even married the chances of her moving are not good. She needs to make dad a deal he cannot refuse to allow her to move and be willing to provide at least half or all of transportation to visits. . Mom has to prove the move is in the kids best interest, and not hers. Sounds like it is in her best interest. His background really does not matter.

hope this helps

from what i have been researching, it looks that if you are under a 100 mile radius, you will not need to get the okay to move. every state is different and i would suggest talking to a local lawyer.

i am not an attourney, this is just some advice. thanks
