Hi there. I've got a court hearing coming up, and am interested in knowing if there are any laws pertaining to visitation that I can pull up on the computer. I am trying to find out if there has to be a seperate bedroom for each child (boy age 3 & girl age 4) to sleep in if my x gets overnight visitation with them. Also, if there is anything that can limit his visitation due to his living conditions: he is living with his mother & his mother's friends in a mobile home on someone's couch. I am hoping that I can stop the overnight visits based on this? Can someone point me in the right direction please! Thanks!

You probably cannot stop overnights because he is entitled to them and it does not mean the children are not safe. You need much more to go on to stop overnights. A seperate bedroom is not required and it does not matter who he lives with especailly if its his mothers. You have to prove that someone in that environment is going to harm the child. The burden is on you to prove it otherwise Dad is entitled to overnight vistation in most cases.

Thanks! I actually have an order already keeping him from having overnight visits-only supervised visitation at this time. He is living in his mother's friends home with their family on their couch. He is just trying to get visitation back now & I don't think he is in an appropriate position to have overnight visits. I appreciate the link- I was able to find some interesting things I will be bringing up as well though!
