CAnnot file papers on deadbeat father because he keeps moving to unknown address

My wife's ex-husband has moved several times to keep from getting subpeona for custody and child support. We do not know where he lives and he has 50% custody under a temporary agreement.

My wife does not want to give up her son's custody. We do not know where he is 50%of the time. Can't we file something to keep him from getting the son until he releases an address to us to know where he is? This 50/50 is not working and she wants full custody as well. We want to go to court to challenge this, but we can't file because he moves every two or three months. This instablity cannot be good for the child.

He is free to move whereever the wind blows.

You are free to file a lawsuit.

You don't have to actually serve the defendant, just make diligent attempts to do so.

Speak with an attorney and bring your action.

The attorney will affect the service after the case is filed.

If Dad constantly moved and you do not have an address for him the chances of him getting custody are slim to none. Does he utilize his 50% visitation now? Mom cannot file to reduce visits just because she doesn't want him to have it..she has to prove its in the childs best interest. Asking for an address and a stable living situation is not unreasonable. mom should talk to an attorney.
