Can you sue for the damages/injuries that a dangerous product COULD have caused?

I was using a large/powerful leaf vacuum/shredder. It sucked up a softball size rock.
The rock was propelled through the wall of the machine and broke a second story gutter. It sounded as if a bomb went off.

The company picked up the machine and stated that there would be an investigation.
They've contacted us and offered us a brand new machine on the condition that we sign a release. The release states that we will not sue them.

The fact that they are asking for a release makes us ask if we could have sued them.
Nobody was injured but my kids were playing just feet from where this occurred.
Is it possible to sue for the damages that a dangerous product COULD have caused?
 
No, you can't sue for what might have happened.
You can only sue for what did happen.
Lawsuits are intended to make you whole.
You can ask for a new machine and for the costs of repairing your gutter.
Thank God you or no other person was harmed.
