can wife take kids?

my wife wants to go away with the kids to another state, can she do that? and if not is there anything legal i can do to stop her?

If there is not a court order (custody, restraining, etc.) preventing her from doing so, then she probably can. Whether she can make this a permanent move or not might depend on the specifics of your state's laws. But, without any custody orders in place, she can legally do just about anything.

If you are not divorced and there are no court orders, either of you have full rights to the kids. She can probably technically take the kids, but a judge may heavily frown upon that and her state she moves to will not have jurisdiction until she has been there for at least 6 months. So you could file for divorce and for custody or return of the kids in your state, and she would have to return to your state for all hearings.
