my wife wants to go away with the kids to another state, can she do that? and if not is there anything legal i can do to stop her?

If there is not a court order (custody, restraining, etc.) preventing her from doing so, then she probably can. Whether she can make this a permanent move or not might depend on the specifics of your state's laws.
