My ex-wife is wanting to modify the child support due her. We have it written in our separation agreement that I will pay $500/month for child support. My understanding was that since it was written into the seperation agreement that, unless we both agreed, the $500 would be the amount paid. I thought that the judge who signed it, said this to me. Could I wrong on this?

She is also going out of town almost every other weekend(the weekend I have the children), going out to movies all the time, and other extravagent things that someone needing money should not be able to do. I have not been able to go out of town for 4 years and cannot afford going out. If I keep track of this, could this affect if she's able to get more money? If she was struggling, I wouldn't mind, but she's better off than me and still trying to get more money.

Thanks for your time.

I'm in North Carolina

Was the 500.00 below your state's guidelines? Her spending habits really do not matter. When did you get divorced? i imagine if you 2 had an agreeent to pay 500.00 she has to prove a change of circumstances. You should talk to an attorney or google your state;s guidelines.

In Florida, from what I understand as the custodial parent, child support can be modified at any time. They simply look at your salary and figure a percentage of it. I believe that it can also be modified by the noncustodial parent if your circumstances change and you are making less money, so I think it can go both ways. But in general my understanding is that yes, it can be modified at any time if she goes through the proper channels (court). PS, maybe someone else is paying for her movie ticket, and really , are movies that expensive? I wouldnt bring anything up that insignificant to anyone because it's a moot point. My understanding is that child support is based on your salary, period. If I am wrong, someone please correct me.
