Can I Relocation?

I'm seeking a divorce from my husband of seven years and we have two children (2 & 4 yrs old). I haven't filled as of yet because I really don't know how to proceed. The grounds will be cruel treatment and we currently reside in New York State and still live together. I am a stay at home mom and desire to move back to my home town in Indiana for emotional and financial support, is that permissible? I do understand that he will want to see his children, however I pretty much raised them on my own and he just covered the financial part of it. Can you suggest a plan for visitation? I know he's going to fight me on this.
 
Who is going to pay for the visits? It is going to be expensive to fly both kids round trip with an adult. He certainly has the right to fight you, and either you should offer to fly the kids round trip a couple times a year, or give him a credit to offset the child support. Price out 3 round trip tickets 3 times a year (around the holidays), spring, and summer and be willing to deduct that from his CS.

It doesn't matter that you say he just covered the financial end of it. He still has a relationship with the kids and you as a stay at home mom, its typical that you are the primary caregiver but doesn't mean Dad shouldn't have any rights.

You really should see an attorney to ensire you are given permission to relocate.
