broken toe

    I tripped over a rack I didn't notice due to long dresses hanging on it and broke my toe, at a Department Store. Do I have a base?

    You mean a case for negligence on the part of the store? Probably not.

    But did you report it to store management when it happened?

    If it's on record there it can't hurt to call the corporate HQ and make a claim. You might get your bills paid and some go-away money or you might get nothing. Still worth a call.

    If you didn't report it to store management when it happened, you can forget about it and move on.

    Maybe, maybe not. Have you contacted the store? Unless there was some sort of negligence they will not be civilly liable but businesses generally carry liability policies to cover these sorts of accidents.
