I am in a dispute with a city in CA. They have offered a settlement of $2,500.00 on an invoice of $4K & have sent me a check for $2,5K. Language on stub (not check) reads," Attached is our check in full payment of items below". I want to take them to small claims. If I cash/deposit the check will that be considered accord & satisfaction and void my right to sue.

Cashing the check could or would be used as your acceptance of the deal. You should not cash it if you are not satisfied with the implications or their offer. Try talking to them and get to an agreement if possible.......if not consider legal action.
