My boyfriend wants to adopt my oldest son. We are planning to get married in a few years, after I finish my degree. The biological father lives in Indiana where my son was born. Is it possible for my fiance to adopt my son before we get married? If so, will we have to do it here or in Indiana? I would like for a lawyer to reply.

No, he will not be able to adopt your son until you've been married for a while. You will also need the father's consent.

Do you know this for sure? I know I have to have the biological father relinquish his rights.

Well, I suppose there could be a state that would allow a boyfriend to adopt, but I doubt it. If you tell me what state you live in, I'll find the statute for you.

BTW-You will need a lawyer for this.

Noprmally parental rights are not relinqueshed unless there is a subsequent step-parent adoption. If you are not married, likely not going to happen.
