Our company entered into a contract with a finance co. to purchase consumer contracts. They are trying to take us to court but, have made many mistakes on the original agreement. The biggest being they dated the contract 1 year prior to our company even being a corporation.
They dated it for July 1, 2005 on the first line of the contract stating this is when the contract begins. We did not even have a company on that date, we incorporated on April 1, 2006. Any advise if this is an enforcable contract or unenforcable. Would the courts find this a simple typing error and allow it to be enforcable. By the way their corporation dated the contract, not ours.
