Temporary Custody orders
The Child and Family Services of North Carolina is required by Federal Law to make "reasonable efforts" to prevent the child from staying in foster care and must make a "diligent search" for relatives who can serve as temporary placement for the child. You or your brother, should contact the social worker and offer you and your mom as placement possibilities. Since you are in another state they would send paperwork to the Social services in your state and they will send someone out to your home to do a home evaluation. They will look for cleanliness, size, background check, safety of the home and general acceptability of the home as a placement for the child. They will come to both homes if you both offer placement.
After this is done they will make a report back to the juvenile court about the appropriateness of your home. If this has not been done I would not spend a lot of money going to that hearing. Don't miss the hearing either, but get it continued until you are ready. It wouldn't be a bad idea to hire an attorney in North Carolina to represent your interests in the matter. He shouldn't charge you much just for that. Remember, they are required to try to get the child out of foster care as quickly as possible. Go get the kids!!!
