Hello,

On June 23rd there was a craigslist prostitute sting set up in Texas and I was targeted. I was arrested, taken to jail, processed and released on bail to await a court date. However, I was never, at any point, read the Miranda. I plan to plead innocent, but my question is, do they have to drop the charges since they never read me my rights??

Any info on the Miranda procedure in a prostitution arrest would be greatly appriciated.

note: I have no previous arrests or criminal history of any kind.

Miranda has nothing to do with charges. Miranda is there for questioning purposes. Anything yuo said to Police may not be used in court since Miranda was not issued. However all evidence outside of your statements can still be used. I suspect it will be enough for conviction. Talk to your Lawyer about your defense plans
