My 12 yr. old son (in public school) had a fight at school and was suspended 2 days. The day he returned I received a call from a district police officer stating she had him at the station. He is being charged with assult. There is not room at the dention facility, and he is being released to parents.
Facts; The officer went to his school. He was taken from class to the principles office. Told he was being charged. Denied a request to call me. Taken to station and finger printed. He was scared to death! I'm angry.. dosnt he have the same rights as we do? He was not read miranda, no magistrate was with him... he was slone. No one from the school called me at anytime (policy states they must immmediately, unless officer gives a valid objection. What and where can I find laws regarding this?
