Am I entitled to my fathers ashes

My father passed away in 1995. My aunt took his ashes out of state. I wanted to know if my brother and I are legally entitled to my fathers ashes, since we are his children. I have prevously asked her several times for my fathers ashes but have been denied. If we are legally entitled to his ashes. how can we go about getting them back to us in California. As this time they reside with my aunt in Kansas, Mo.

Did his will say anything about the ashes?

If not, you that you and your siblings almost certainly have a stronger legal claim to them than your aunt. You should consult with a local estates lawyer.

My father did not have a will, and never stated who should get his ashes in the event of his death.
