Advice on getting ex out of house and getting custody of child

My ex is currently in my house and will not leave. He can be physically abusive and verbally abusive. This weekend I left the house with our child. I'm afraid he is going to say I kidnapped her, but I did not. I just do not feel safe in the house any longer. He knows where I am. There are many holes he has punched in the walls and he has pushed me around before (no marks or brusies left on my body). I would like to get him out of my house and get custody of the child. He is not a bad father he makes the child laugh and they have fun together, it's just he does not do the activities like feeding, bathing, etc. I don't want to take the child out of his life completely because I know the child loves him. The child is only 9 months old so I would like for them to be able to spend time together. I'm just worried that he may not want to give her back to me when I let him see her. I need to know what steps to take to get him out of my house and then how to go about getting custody. I really do not want to state all the bad things he has done because it could turn into something an ugly drawn out mess, but I'm afraid that is the only way I'm going to get him out of my house and get custody of the child.

Dad does have rights to custody and visitation. You really nee to see an attorney. Until a court says otherwise Dad does not have to leave the house, and you both have equal rights to the child.

Your house has nothing to do with custody. Whos name is the house in? Sounds like its his house too.
