4 10 hour days and vacation pay

I work for a County agency and we recently went to 4 10 hour work week. When a holiday comes around we have to use 2 hours vacation to get our full 40 hours is this legal? I dont understand why we should be forced to use our vacation to get our full 40 hours.
 
Think of it this way...

Your employer is giving you 8 hours free for the holiday. He is not giving you 10 hours free. Thus if you want the full 40 hours during a holiday week, you need to chip in the additional 2 hours from your accrued vacation time. If you have no vacation time available, you would then only be paid for the 38 hours.

You aren't losing anything, it just appears weird because you are use to an eight hour work day. Your work day is not 10 hours, but your holiday fringe benefit is still only 8 hours.
