my husband is in jail on a 3rd dui. what will happen now? will he have to do time?

More information is needed. In my State, the amount of jail time for third offence varries tremendously. It can be years in prison, it can be weeks in jail. . . One can be convicted of 3rd offense (Feloy) or plea reduced to a misdemeaor. . .

I'm sorry but you probably need to consult local attorneys.

For example, within my STATE it varies greatly between counties what will happen.

For example, in one county, a second offense DUI the prosecution never plea bargains, and many are alooking at 90 days in jail and oppressive probation for 2 years.

Then, in another county a 3rd offense DUI always gets pleaded down, and they undergo very minimal probation. . .

I know absolutely nothing about houston, so it's important to consult with a Houston based defense attorney. I don't even know if your Husband is charged with a felony or not. Laws on DUI are all over the place in this county except for the past few years on the BAC level (.08).
