I have a question. My girlfriend is a bartender and on her day off, went to the restaurant where she is employed and drank. There is no policy stating that any employee is banned from drinking at the restaurant on their day off or after their shift.

Her employer said she was drunk, insisted on driving her home and called the next day and suspended her for two weeks.

He said he was making an example of her since she was a manager.

Does she have any recourse? She was not on the clock. She is not the only manager to drink at the restaurant.

Thansk for your advice. Let me know if you need more information.

If she was indeed drunk and intending to leave the bar in such a state, then I'd say the employer did the right thing. She as a manager did the Bar an injustice by trying to leave the establishment and drive drunk. This could have placed the bar owner in legal jeopardy.

Does she have any recourse?
No, and she should pray she does not get demoted or possibly fired. (If the employer insisted on driving your girlfriend home and she allowed him, then she probably was not sober).
