Hello. My question is this, my father, who is alive and well, has a piece of property approx 13 acres in the mountains of Pa. This property has been willed to all of his children (myself and 3 brothers), I am his executor. Since his will, one of my brothers convinced my Dad to allow him to build a home on the property, and quickly started construction. My father is concerned as to how this would play out, he wants to ensure we all get an equal size/price of property, he is also concerned that since my brother has a building there he could claim all the land. I say sub divide out in the Will.

I would think you could all still get an equal size/share of the property. Your Father could talk to the lawyer who did the will to be on the safe side.
