    Just got served!

I'm sure his position is that your sister was not entitled to the return of the funds and neither are you. You can't just change her retainer into yours. Sounds like a crazy fact situation. Good luck to you.

my grandfather's land steal by his adopted brother but not legally adopted.

No-one on this board will be able to answer your questions. My suggestion would be to contact the police about the fraud and press criminal charges, and scrape together the money to hire a lawyer.

I am looking for advice on selling a house

I suspect you can avoid probate, but I'm not a Tennessee estates lawyer. I'd suggest consulting with one. I wouldn't sell the house until your mom's estate has been dealt with.

    Short Sale Gone Bad

Slow down. Did you and them enter into an agreement that they would refund your deposit and out of pocket expenses, or not? What is this new agreement? They don't get to "decide" what you are going to do. They might want you to sign something, but have you actually entered into it? Why...

Do I have any way to save my Texas property if I am delinquent on property taxes?

What law office? Who is "they"? On what legal basis do they make this decision about what you can do with your properties? The rational solution is to sell one and use the proceeds to pay down the taxes on the other.

Naturalization, Citizenship Birthrite citizenship for Canada

As I understand it, the right to Canadian citizenship is acquired from one's parents, not from one's grandparents. Unless your parents were registered and obtained a Registration of Birth Abroad, your parents were not Canadian citizens, and you don't have a right to Canadian citizenship.

Sibling wants to stay in parents home but....

Whether he signs something or not probably won't make much difference. If he doesn't sign anything, he's just staying there at your parent's pleasure, and he can be kicked out whenever they please. If he does sign something, and he overstays his welcome, he might arguably be in breach of...

She can sue. Foreign nationals are not barred from suing in US courts. Whether she will win is anyone's guess.

    "Poison Dart" clause in will

Have you seen the will? If not, ask her for a copy. I suspect BS.

I am looking for advice on selling a house

The proper thing to do is probably probate your mom's estate and have your sister quitclaim or otherwise deed her interest in the house to you. You might be able to avoid probate by doing an affidavit of administration or something similar, depending on your jurisdiction and the value of the estate.

    real estate

What is your jurisdiction? It looks like an unusual way of saying that the owner's title shall be sufficiently proven. In deed systems, that means deducing it from the chain of title.

    status of business under trust

There are three entities you need to distinguish here: the trust, the business (at one point, at least, an asset of the trust), and the LLC (which appears to have current operational control of the business). The business is not, strictly speaking, "in its new form as an LLC". It is separate...

    Just got served!

You feel he owes you what money? I thought you never paid him. What are you counterclaiming for? Not under any law I'm aware of. Maybe under the rules of his local bar association, whatever those might be. Depends what you're counterclaiming for.

I am looking for advice on selling a house

Your sister is almost certainly entitled to half the house under the intestacy laws of your unnamed state. I think you mean a quit claim deed. I'm not sure how the prospective purchasers think that will help you. Say more about this proposed transaction.

    joint tenant with survivorship

The only way to be sure about these questions is to see an estates attorney. Generally, yes, if one dies, the other takes full possession of the house and bears the responsibility for the mortgage. How you get the other person off title depends on the the land title rules in your...

How Do I enforce civil code violation

Just curious, are you sure the provision applies? Do you live in a "residential hotel"?

I am looking for advice on selling a house

The quick answer is probably no. But what has happened with the distribution of your moms estate? Did she leave a will?
