So me and my ex boyfriend broke up because I caught him cheating. Can he legally have me arrested over a T-shirt and some movies because I don't want to return them? He threatened me and said that if I don't return the items he will come and take them from me. I told him to stay off of my property and if he shows up to my property I will call the police for trespassing. I need some advice! He threatened to come to my house when he knows that no one will be there with me but myself. I already warned my neighbor who is a police officer.

The fact that he cheated does not make his stuff your stuff and he is entitled to it back. You don't want to let him in the house, fine, you don't have to. But that doesn't mean you're entitled to keep his stuff. Mail it to him or arrange a meeting at the local McDonalds (or better yet the local police station) to give it to him.

He can't have you arrested over this, but he could potentially sue you in small claims for some petty amount. It is easiest for everyone if you find away to return his stuff.

If he is threatening violence then don't hesitate to obtain a restraining order to compel him to stay away from you and your home.

So some lousy dude to whom you aren't married allegedly cheated with some woman or man, so what?

The dude means nothing to you LEGALLY.
Thank your lucky rosebush you found out before the cheater sired a child with you, or worse yet, married you.

Mail the cheater his lousy T-Shirt and other junk, and avoid the drama.

When you mail him his junk, ask him never to contact you again, and vow to yourself never to contact the cheater again!

We have no way of knowing what abilities he has. Obviously, if he's not a cop himself, he cannot arrest you (except by making a citizen's arrest, if that's allowed in your state). I'm not exactly sure what you mean by "have me arrested," but he obviously can ask that the cops arrest you. It's certainly illegal for you to retain his property, but I doubt most police departments will get involved with something like this. Why not just give him his stuff back and move on?

I need some advice!

Ok...stop behaving like a child and give him his stuff back.
