Crazy Wreck but no injuries

Hi this past Sunday I was involved in a freak accident read carefully as it can get confusing. Myself, wife, brother-in-law, and cousin (all over the age of 21) had been at an ATV riding park. We loaded our side by side utv units (2 a Honda and a rhino) onto an 18 ft car hauler trailer (flat bed with no side rails). Both units were tied down with ratchet straps. The trailer had lights and reflective tape. We left the park in the left hand lane of a 4 lane highway headed south. We came to red light goin down hill (all the weight of the utvs were shifted towards the front of the trailer) as we were stopped, there was no one behind us. the light turned green and started through the light we made it approximately 15-20 ft into the intersection we felt a hard jar from the back pushing myself and all 3 passengers forward. my brother-in-law said "someone hit us"(the vehicle that struck us was a company truck with 4 occupants) then he turned looked out back glass and said "your buggy is off the trailer rolling through the intersection". I attempted to find a shoulder to pull off on and he said "a car just hit the buggy". We pulled down to a median cross over and turned back north towards the utv and pulled over at a gas station. My Bother-in-law got out of my truck headed towards the utv to attempt to move it from oncoming traffic and before he could reach the unit an 18-wheeler struck the utv totaling the unit out. We were at the scene approximately an hour before the police came to my vehicle (which I understand trying to clear out highway for other traffic). When the police came the officer asked who was driving I told them I was he asked for my driver license and insurance which I had both. Then the officer asked if there were any passengers I said yes and told him who he then asked for their IDs which they all had. The officer wrote done the Driver License information for each of us handed our IDs back and walked away. We continued to stand therefor another 30 minutes until the officer that had asked for IDs and another officer came back asked if I had a preference to where my utv was hauled and said we were free to go. The officers never got a statement from me or any of my passengers nor did we receive a police accident report or sign anything. The next morning I went to the junkyard with my brother-in-law to see the utv and the truck (Ford F250). We took pictures of my utv and talked to the owner of the junkyard and he told us he hauled the truck to the companies yard 45 minutes away. We got the address and went to the companies office where the truck was. We took pictures of the truck and on the truck s bumper is a piece of reflective tape that came off of my trailer (I have pictures of both). My utv was valued at $10,300 I owe approximately $5,000 on it. If the company only pays me what the unit is worth and I take the money to pay off the unit I will only have around $5000 left which is nowhere near what a new unit cost. That was only the 2nd time my unit had been on a trailer (the other time was when I bought it). I have a farm and use the utv on the farm for checking cows, hauling feed and materials, and various other things. I am a school teacher and don't jus have money to go out a buy a new utv. I have 1 speeding ticket on my record other than that its clean. I guess my question is #1 why did the police not get a statement from me or my passengers and give me insurance information for the truck that hit me #2 is the company liable for replacing my UTV fully or jus what its worth and #3 should I get a lawyer or just let insurance handle this.
 
Make it easy on yourself, report the matter to your insurance carrier.
I suspect the police MIGHT still be investigating the matter.
What you've described seems to have been initiated when your vehicle somehow came off your trailer.
I suspect the damage claims are flowing in, and blame is probably gong to apportioned to you.

The police were called, which was appropriate.


In Mississippi, however, a written accident report must be filed with the police within 10 days if someone is hurt or the property damage exceeds $250.
Failure to file a report is a misdemeanor and could lead to a suspended driver's license. Providing false information in the report is illegal.

Mississippi law does not require the driver to file a written accident report. A police report is required.
The Department of Public Safety may require any driver of a vehicle involved in an accident to file a supplemental report on an official state traffic accident report if the original report is deemed to be insufficient.

You may be required to file a supplemental report of YOUR version of this occurrence in written form, if the one created by the police is found to be insufficient.


Make sure your insurer is informed and advises you further.
Your damages may become insignificant, as the claims begin to roll in and add up.

Agree to always start by informing your auto ins. carrier of any accident. They will go from there.
 
Insurance

Yes I contacted my insurance first thing the following morning but my utv didn't jus fall off I was rear ended causing the utv to come off the trailer
 
Was it because of the section of trailer damaged or did you fail to properly secure the load. That may be an issue for a court to decide. Lets start with a basic concept. How much did the UTV weigh? What were the straps rated for? Did you have at least two securing it from moving ?
 
The lack of a police report/statement was likely due to there being no injuries. The matter is left to insurance and civil courts to sort out.
Wait and see what your insurance company offers to do before deciding if you need to hire an attorney.
