Right to inform?

Several years ago I went through a very contentious divorce. During the lengthy proceedings my now former spouse had a family member use his access to my information with his employer to gain access to mt personal information (this has been substantiated and this member was fired from his job). Being angered by getting fired, he began "stalking" me (i.e... following me to work, on the weekends, and finally burgled my home). After the burglery, this member had stolen very personal information and also had access to my social media, work access, and financial records. He used this information to, over the course of a week harass me online, telephone and at work... including e-mailing and calling my co-workers, friends and family. I received an Injunction against him... on the morning of the Injunction hearing I go out to my vehicle, only to see that it had been vandalized (only vehicle on the block to have this done).

Fast-Forward 2-year and he just recently found another job a few months ago working in the same industry he was fired from for compromising personal information. This is appalling to me, plus he was finally charged with several counts of identity theft and fraud because of his actions towards me over the last few years.

I feel disgusted that an employer would have hired him, knowing he was fired from his last job for stealing information and violating company policy. Which, makes me believe that they do not know. Being that he is charged, and the evidence is incontrovertible.... but I fear that he will get away with it since he has a "high powered" attorney fighting for him, and I don't believe in the legal system that has allowed his harassment to continue for several years... I want to inform his employer of the charges, his past harassment and the real reason he was fired from his last job.

My only fear.... he will try to sue me for libel. I do not believe the "system" will hold him accountable and let him off with a slap on the wrist as this is his first offense (even-though all charges are designated and F5 or higher). The information to be presented is true and verifiable..... I know that technically it seems petty, but I believe if given the opportunity, he would do this again and the employer has a right to know what he has done.

But, he will not stay out of my life. He burgled my home, slashed my tires, harassed me..... He must have lied to this employer to get a job dealing with peoples personal information. He is being charged with fraud and identity theft FINALLY.... but, it's my sense that he's going to get off easy.

Granted , this is a petty and vengeful move, but since it's true.... would he have grounds to sue me?

If he could connect the dots, it would reveal your face and finger prints all over it!

Disagreeable gave you very sound advice.

You do NOT know how he obtained his current position.

You also don't have a need to know.

If I were you, I wouldn't be inclined to pull the tiger's tail!!!!

And, just so you know, there is no "RIGHT TO INFORM" under our laws.

There is, however, an inherent RIGHT TO PRIVACY.

I'm just saying!
 
I believe I know that both of you are correct.... That is why I have been hesitant to do anything. It's just frustrating at how he made my life HELL for almost 3-years with his shenanigans, cost me thousands of dollars and legal fees and from speaking to his prosecutor, they're going to offer him a plea deal -- granted he will be labeled a felon for the rest of his life.

The system is just so broken....

There are employers who will knowingly hire someone with a criminal record; there are even employers who will go out of their way to do so. A colleague of mine worked at one time for a company that worked with the local prison, who placed released prisoners with them to help them build up an employment record so that they could later get other jobs and avoid other criminal activity (based on the fact that they could not get a job to pay their bills).

My point is that just because you wouldn't hire him if you knew his history (I doubt my employer would either) doesn't mean that no employer would.
 
He would not win a libel case against you because you would be informing a third party of something that you reasonably believe to be true.

HOWEVER, you would have to be an idiot to provoke him to terrorize you all over again. May end a lot worse for you next time! If he isn't harassing you now, leave the past in the past. Chances are that his new employer knows anyways.
